Not open procedure

A restricted procedure is generally possible for any contract value. In areas where direct award or negotiated procedure are no longer permitted, an open, restricted or other procedure must be chosen.

In the area of national thresholds, contracts are usually awarded by open or restricted procedure (Article 22, paragraph 5 ÖAWG). Contracts awarded by contracting authorities in the sector are awarded by open, restricted, negotiated, competitive dialogue or innovation partnership procedures, as appropriate (Article 33, paragraph 1 ÖAWSG).

The restricted procedure is a two-stage procedure. In the first stage, any interested person may apply for an invitation to bid on the basis of the announcement. An announcement must be made in all cases. In a second stage, the client may limit the number of persons it invites to submit an offer, provided that suitable applicants are available in sufficient numbers. However, the number of persons invited to submit an offer may not be less than five. The contracting agency shall specify in the notice or invitation to bid the objective and nondiscriminatory criteria or rules it intends to use, the minimum number it intends to invite, and, if applicable, the maximum number of candidates to be invited (Article 24, paragraph 2 ÖAWG or Article 35, paragraph 2 ÖAWSG).
