Notification register

The Office for Communications (AK) is the regulatory authority responsible for postal and parcel delivery services and, as such, maintains a register of postal service providers (cf. Art. 5 para. 3 of Postal Services and Parcel Delivery Services Act).

Notification obligation

Art. 5 of the Postal Services and Parcel Delivery Services Act stipulates that the commencement of the provision of postal services is subject to notification only. This means that all activities related to postal and parcel delivery services can generally be provided without authorisation. The procedural requirements are limited to a written notification to be submitted to the regulatory authority (Amt für Kommunikation, Äulestrasse 51, Postfach 684, 9490 Vaduz).

According to Art. 5 para. 2 of the Postal Services and Parcel Delivery Services Act, this notification must contain certain minimum data, in particular information that is required to identify the company concerned.

Notification obligation

1) Postal service providers must notify the regulator in advance of the commencement, change or discontinuation of the provision of postal services in Liechtenstein in a form specified by the regulator.
2) The notification pursuant to para. 1 must contain the following information and documents:
a)       the name, legal status and legal form, the number of entry in a commercial register or similar register, the value added tax number (VAT No.) or the company identification number, the registered office, and the delivery address of the postal service provider;
b)       the contact details of a person authorised to represent the company or an agent for service in Liechtenstein;
c)       a current extract from a commercial register or similar register;
d)       the characteristics and a detailed description of the services offered by the postal service provider.
3) Registered postal service providers will be listed in a register by the regulator and published in appropriate manner.
4) The Government may, in accordance with Art. 9 of Directive 97/67/EC, regulate the details of the notification obligation for postal service providers by Ordinance.
