Prerequisite for the granting of authorisation
Permission to acquire ownership of domestic land plots is granted upon application if there is either a legitimate interest in the intended acquisition of ownership of land plots, i.e. if:
- the land to be acquired serves the acquirer or his/her family to meet an existing or future domestic housing need

the property to be acquired serves the acquirer or his/her family to meet a current recreational need.
- if the land to be acquired serves the acquirer to establish on it the business premises of his/her domestic business;
- if the property to be acquired serves the acquirer for the full-time or part-time management of his/her domestic farm for the production of agricultural products
- the land to be acquired serves an overbuilding with condominiums or rental apartments or the creation of commercial premises;
- the land to be acquired serves purposes of social housing
- the land to be acquired represents the land reserved for agricultural use
- the land to be acquired of a foundation, an institution without members or a trust similar to a foundation with personality serves to cover a beneficiary a certain legitimate interest;
or
- the acquisition by a spouse, a registered partner, a blood relative in the ascending or descending line or up to the third degree of the collateral line, or an elective or foster child occurs;
- the acquisition by way of an exchange with an equivalent property takes place;
- the land to be acquired represents an equivalent substitute for land given to the country or municipality;
- the acquisition by way of a will, codicil, inheritance contract or legacy contract occurs;
- the acquisition by way of forced auction, provided that the award is made to a person of full age with nationality or to a domestic legal entity.
