Special provisions for personnel leasing

In the case of direct and indirect staff leasing, the provisions of the Act on Employment Placement and Staff Leasing (Arbeitsvermittlungsgesetz, AVG, LGBl. 2000 no. 103) and the associated ordinance to the Employment Placement and Staff Leasing Act (Arbeitsvermittlungsverordnung, AVV, LGBl. 2000 No. 146) must be observed. In particular, the principle of equal treatment according to Art. 19a AVG applies.

Furthermore, there is a generally binding collective labor agreement (aveGAV) for personnel leasing. This is applicable if there is no other (industry-specific) aveGAV for the activity of the posted employee, which is more favorable to the employee.
