Importers have the same legal status as manufacturers, i.e. the legal regulations for manufacturers apply equally to importers.
Manufacturer is any natural or legal person with domicile, place of business or branch office in Liechtenstein who professionally or commercially manufactures, extracts or imports chemicals. A manufacturer is also deemed to be anyone who obtains chemicals under CH law or under EEA law and supplies them under his own new trade name or for a different purpose or in packaging than that intended by the original manufacturer.
Imports can be made according to Swiss regulations or according to EU/EEA regulations.
Manufacturers / importers, as "preparers of safety data sheets", are obliged to notify the Office for Environmental Protection of a chemical contact person, who must be notified using the appropriate form
Chemicals are distributed commercially by wholesalers or retailers, with wholesalers distributing chemicals exclusively to professional and trade customers and to intermediaries. Distributors who dispense certain hazardous chemicals must notify the Environmental Protection Agency of a chemical contact person using the appropriate form to report.
The wholesaler must supply the relevant safety data sheet to the purchaser and must know and be able to interpret the contents of this.
The retailer also sells chemicals to private individuals and thus has to fulfill special obligations, such as recording the levies and informing customers about the hazards. The dispensing of particularly hazardous chemicals to private individuals may only be done under the guidance of a person with a certificate of expertise.
Professional and commercial users have to comply with a number of obligations when handling chemicals. Safe storage, use in accordance with regulations, proper disposal and handling subject to authorization are to be taken into account.
The use of pesticides, pest control agents on behalf of third parties, agents for the disinfection of bathing water in communal baths and wood preservatives, as well as the handling of refrigerants, may only be carried out by natural persons with an appropriate professional permit or with a qualification recognized as equivalent, or under the guidance of such persons. Pest control with fumigants, on the other hand, may only be carried out by professional licensees or by persons with a qualification recognized as equivalent.
Businesses that handle hazardous chemicals must designate a chemical contact person. Unsolicited, this must be communicated if the activity involves pest control, bath water disinfection or attic treatment with wood preservatives. The notification shall be made using the appropriate form
In order to place dangerous substances and preparations on the market in an EU/EEA member state, the respective national regulations of the member states must be observed in addition to the applicable EU regulations.
Chemicals whose use/marketability is strictly restricted or completely prohibited in the EEA can only be exported from the EEA and imported in third countries after notification and notification and with the knowledge of the relevant authority of the importing country.
