According to the Act on Public Procurement (ÖAWG) or the Act on Public Procurement in the Sector (ÖAWSG), all public

Construction contracts
Supply contracts
Service contracts

which are awarded by contracting authority pursuant to Article 2 ÖAWG or Article 4 ÖAWSG, on the basis of the statutory provisions.

The description of the relevant construction contracts can be found in Annex 3 and 4, those for service contracts in Annex 5 and 6, the Kundmachung der Schwellenwerte bei der Vergabe öffentlicher Aufträge resp. the announcement of the thresholds for the award of public contracts in the sectors.

Supply contracts are defined in the Commission Regulation 213/2008 on the Common Procurement Vocabulary

Exceptions are described in Article 5 of the Law on Public Procurement ÖAWG or in the Articles 8 to and including 18 of the Act on Public Procurement in the Sectoral Field
