Reporting of employees
The Office of Statistics and the Migration and Passport Office maintain information on employees in Liechtenstein companies in the Central Personal Register of the National Administration on the basis of employee reports.
Who must report employees?
Companies domiciled in Liechtenstein, self-employed persons, as well as employers of domestic and home care staff are required by law to report entries and exits of employees to the Liechtenstein National Administration and to the Liechtenstein AHV-IV-FAK using an electronic reporting form.
Companies may also transmit the entire headcount from the payroll accounting program, provided the payroll accounting program supports this.
To whom do the reports go?
The employee reports sent to the Liechtenstein National Administration are sent to the Office of Statistics, the Office for Migration and Passport and the Liechtenstein AHV-IV-FAK for processing. The reported information is also used by other official offices which have a legal basis to do so.
What else needs to be considered?
However, the notification of employment does not replace
- obtaining a corresponding permit under immigration law from the Migration and Passport Office;
- the registration and deregistration with the Family Compensation Fund (FAK).
- the registration of generally binding collective labor agreements at the ZPK SAVE.
Legal basis
The legal basis for the declaration requirement is the E-Government Act, LGBl. 2011 No. 575, the Old Age and Survivors Insurance Act, LGBl. 1952 No. 29, the Foreigners Act, LGBl. 2008 No. 311, the Free Movement of Persons Act, LGBl. 2009 No. 348, and the Statistics Act, LGBl. 2008 No. 271.
The categories of personal data to be collected result from the above-mentioned legal provisions as well as from the corresponding instructions and online registration forms.
