27/05/2021: Extra charge for paper invoices – update

The Office for Communications points to the amendment to the Ordinance of 9 June 2020, Liechtenstein Law Gazette 2020 No. 191, regarding (paper) invoices and billing pursuant to Art. 55, para. 1, sentence 2 of the Ordinance on Electronic Communication Networks and Services. The previous wording of the provision, according to which free invoices and billing statements must be provided in paper form upon request, was amended as follows (translation; German version applies in cases of doubt):   

The subscriber shall be given the option of receiving the itemised bill free of charge on request for each connection on a durable medium.

Durable medium means, in particular, paper (invoice), USB sticks, CD-ROMs, DVDs, memory cards, hard disks of computers as well as e-mails.

Operators therefore generally have the option of providing invoices or billing statements in electronic form, provided that the customer expressly agrees. In order to ensure the customer's freedom of choice, the customer must expressly agree to an invoice in electronic form. Customers must therefore be given the option of choosing between an invoice in electronic form or paper form when concluding the contract. The option of receiving invoices in paper form free of charge must not be excluded by contract.
