Exchange with equivalent property

A legitimate interest is not required if the acquisition is made by way of an exchange with a property of equal value.

Equivalence

The equivalence of the plots of land is assessed in particular on the basis of the area measurement, the utilization factor and the zone affiliation.

Equivalence, on the other hand, does not have to be given in terms of the price.

If there is no equivalence, this cannot be achieved by any compensation payment.

When exchanging a plot of land with a condominium, the condominium share (quota) is to be apportioned to the building’s floor area.
