Dynamic procurement system
The contracting authorities may set up a dynamic procurement system for the procurement of services customary in the market. All communication shall be exclusively electronic. The dynamic procurement system shall be carried out as a non-open procedure in all phases from establishment to award (Article 24a, paragraph 1 ÖAWG or. Article 35, paragraph 1 ÖAWSG).
All tenderers who meet the eligibility criteria are admitted to participate in the system. The number of participants may not be limited. If the dynamic procurement system is divided into categories of works, supplies or services, the contracting authority shall determine the eligibility criteria for each category (Article 24a, paragraph 2 ÖAWG or Article 35, paragraph 2 ÖAWSG).
A separate invitation to tender must be issued for the award of each individual contract (Article 24a, paragraph 3 ÖAWG or. Article 35, paragraph 3 ÖAWSG). The further provisions on the dynamic procurement system are regulated in Art. 28a ÖAWV or Art. 33a ÖAWSV.
