02.04.2025: Termination of Contracts

Art. 17, para. 1, lett. c, subpara. 1 of the Communications Act (KomG, Law Gazette 2023 No. 216) requires that providers of publicly available electronic communications services offer consumers contracts that

“do not exceed an initial minimum contractual period of 24 months and (...) in particular do not include any period for the termination of the contract that exceeds one month or any costs related to the termination of the contractual relationship”.

This regulation implements Art. 105 (3) of Directive (EU) 2018/1972 into national law. Accordingly, consumers have the right to terminate their contract at any time with a notice period of no more than one month without incurring any additional costs beyond the regular fees for using the service during the notice period.

In practice, this means a change from previous regulations: the notice period of one month may no longer be linked to the condition “at the end of the month”. Such a restriction would no longer be compatible with the new legal situation.

Example: If a consumer terminates their contract on March 5, the contractual relationship ends no later than April 5. A regulation that would allow the contract to expire only at the end of the month, in this case on April 30, would violate the legal requirements.
