Restricted procedure

In principle, a restricted procedure is possible for any contract value. In areas where direct award or the negotiated procedure are no longer permitted, an open, restricted or other procedure must be selected.

In the area of
national thresholds, contracts are generally awarded by open or restricted procedure (Article 22, paragraph 5 ÖAWG). Depending on their appropriateness, contracts from contracting authorities in the sectors are awarded by open or restricted procedure, negotiated procedure, competitive dialog or as part of an innovation partnership (Article 33, paragraph 1 ÖAWSG).

The restricted procedure is a two-stage procedure. In the first stage, any interested party can apply for a request for proposals on the basis of the contract notice. A contract notice must be published in any case. In a second stage, the contracting authority may limit the number of persons it invites to submit an offer, provided that a sufficient number of suitable candidates are available. However, the number of persons invited to submit a tender may not be less than five. In the contract notice or invitation to tender, the contracting authority shall specify the objective and non-discriminatory criteria or rules it intends to apply, the minimum number of candidates to be invited and, where applicable, the maximum number(Article 24, paragraph 2 ÖAWG or Article 35, paragraph 2 ÖAWSG).
