International Affairs announcements

In the area of International Affairs, the following three main types of notices are distinguished:

  • Prior information notice
  • Contract notice
  • Contract award notice

Prior information notice

For contracts above the thresholds, with the exception of the negotiated procedure without prior publication, the contracting authorities use a prior information notice to announce the works, supply or service contracts they intend to award in the next twelve months.

Contracts above the threshold values, with the exception of negotiated procedures without prior publication, must be published in German in the official Liechtenstein publication media by means of a prior information notice (Article 14a, paragraph 4 of the Public Procurement Ordinance) and forwarded to the Office for Official Publications. The contracting authority may send this prior information to the Specialized Unit for Public Procurement for review ten days before publishing. A confirmation of publication issued by the Office for Official Publications of the European Union stating the date of publication shall be deemed to be proof of publication(Article 14a, paragraph 1 of the Public Procurement Ordinance).

The content of the prior information notice is governed by Article 14, paragraph 3 of the Public Procurement Ordinance.

The transmission of the prior information notice to the Office for Official Publications must take place within the shortest possible time and by electronic means, taking into account the information in Annex VIII No. 3 of Directive 2014/24/EC on the model and procedure.

The period between the prior information notice and the contract award notice must be at least 35 days and may not exceed 12 months, otherwise a new prior information notice must be published. A prior information notice leads to a shortening of the deadlines.

The contracting authority may also publish the prior information notice in a procurer profile. It shall notify the Office for Official Publications of the European Union electronically in advance of Publishing in a buyer profile. It may set up the buyer profile on the Internet; it contains information on planned and ongoing procurement procedures, on contracts awarded and all other information relevant to the award of the contract, such as the contact point, telephone and fax number, address and e-mail address of the contracting authority. The prior information notice may not be published in the Liechtenstein publication media prior to Publishing by the Office for Official Publications of the European Union. Publication in the Liechtenstein organs of publication may, however, take place if the contracting authority has not been informed of the publication within 48 hours of confirmation of receipt of the prior information notice(Article 14, paragraphs 3 and 4 of the OOIP). It may only contain the information that has been forwarded to the Office for Official Publications of the European Union or published in a buyer profile and must refer to the date of forwarding to the Office for Official Publications of the European Union or publishing in a buyer profile.

Publication

The intended award of public contracts must be published by means of a public notice (advertisement) in the Liechtenstein official publication media in German(Article 17, paragraphs 1 and 2 OAWV) and forwarded directly to the Office for Official Publications and forwarded directly to the Office for Official Publications. The notice must be transmitted to the Office for Official Publications of the European Union as quickly as possible and by electronic means, taking into account the information in Annex VIII No. 3 of Directive 2014/24/EU on the model and procedure for transmission.

Public contracts shall not be published in the Liechtenstein official publication media prior to Publishing by the Office for Official Publications of the European Union. However, publication in the Liechtenstein official publication media may take place if the contracting authority has not been informed of the publication within 48 hours of confirmation of receipt of the notice.

Publication of awarded contracts

Contracting authorities must send a notice to the Office for Official Publications of the European Union within 30 days of the award of works, supply and service contracts or the conclusion of a framework agreement or a design contest. The sender must be able to prove the date of dispatch. A confirmation of publication issued by the Office for Official Publications of the European Union stating the date of publication shall be deemed to be proof of publication(Article 42, paragraph 1 of the Public Procurement Ordinance).
The content of the contract award notice is governed by Article 42, paragraph 1 of the Public Procurement Ordinance.

The awarded contracts are published in the official publication organ using the template "Notice of awarded contracts".

In the case of framework agreements, a notice with the results of the respective award procedure does not have to be sent for each individual contract awarded on the basis of this agreement(Article 42, paragraph 4 of the Public Procurement Ordinance).

The contracting authority shall send the Office for Official Publications of the European Union, within 30 days of each contract award, a notice containing the result of the award of the individual contracts awarded under a dynamic purchasing system. However, it may summarize this notice on a quarterly basis. In this case, it shall send the summary within 30 days of the end of the quarter(Article 42, paragraph 5 of the OEAWV).

The contracting authority may summarize and publish the notice on the award of contracts for social and other specific services on a quarterly basis. In this case, it shall send the summary within 30 days of the end of the quarter. Information on the award of a contract or the conclusion of a framework agreement does not have to be published if its disclosure would impede the enforcement of the law and the ordinance, be contrary to the public interest, harm the legitimate commercial interests of public or private undertakings or prejudice fair competition between them(Article 42, Paragraphs 3 and 6 of the ÖAWV).
