Compensation for damages

The provisions on compensation for damages can be found in Article 61 of the Law on Public Procurement and Article 77 of the Law on Public Procurement in the sectors.

Tenderers have a legal claim to compensation for damages caused to them by contracting authorities through decisions or rulings that have been found to be unlawful. The claim for damages shall cover the expenses incurred by the tenderer in connection with the award and appeal procedure. Unless otherwise stipulated in this Act, the provisions of the Public Liability Act shall apply mutatis mutandis.
